Owner’s obligations

As the owner of a rental property, there are a number of guidelines, regulations and standards that must be met before a tenancy can begin.
You will find the most important of these listed below, however a full list can be found at www.direct.gov.uk

Electrical appliances
Every electrical appliance must be safe to use and must carry a safety certificate as proof. An operating manual should also be provided for each one. Unlike the Gas Safety Regulations, there is no mandatory requirement for the equipment to undergo any safety testing, but it is recommended that all electrical appliances are thoroughly tested before the property is let.

Fire and safety regulations
New fire and safety regulations came in to force on 1st October 2006. These regulations provide a list of furniture and soft furnishings that must meet fire safety standards.
Furniture and furnishings that must comply with these standards are:

  • Beds, headboards of beds, mattresses
  • Sofas, sofa-beds, futons and other convertibles
  • Nursery furniture
  • Garden furniture which is suitable for indoor use
  • Furniture in new caravans
  • Scatter cushions, bean bags, window seats and seat pads
  • Pillows
  • Padded stools and padded chests (Ottomans)
  • Put-up beds and garden loungers or seats
  • Loose and stretch covers for furniture

Nb: Furniture manufactured since March 1989 will comply with these regulations, and most will bear a label indicating this.

Furnishings that do not need to comply with these standards are:

  • Sleeping bags
  • Bed-clothes (including duvets) and pillowcases
  • Loose covers for mattresses
  • Curtains and carpets
  • Furniture and furnishings manufactured before 1 January 1950

Plugs & Sockets: Safety regulations 1994
In 1994, a law was passed requiring any plug, socket or adapter intended for domestic use comply with a set of government standards.

Gas and Oil Safety Regulations
The Gas Safety Regulations passed in 1998 place a statutory duty on all residential homeowners to ensure that all gas appliances, pipe work and flues are maintained in a safe condition. By law, an inspection of all gas appliances must be carried out annually by a registered Gas Safe Register engineer. After inspection, the engineer will issue a certificate as proof of inspection, which should be duplicated and kept at the property, see – www.gassaferegister.co.uk . Oil fired appliances must also be checked on an annual basis.

Smoke Detector Act
The 1991 Smoke Detectors Act requires that all new houses built since June 1992 must, by law, have a mains smoke detector installed. The minimum requirement is one smoke alarm on each level of the building. This law does not apply to properties built before June 1992, but homeowners should be aware that they are likely to be held to account and face serious claims if sufficient smoke detectors are not installed.

Insurance
As a homeowner, you must ensure that the property being let is fully insured. However, the tenant is responsible for any possessions that they bring into the property.

Payment terms
The homeowner must clearly state the payment terms to the tenant.

Arrival and departure times
Homeowners should clearly state the arrival time at the start of a new tenancy, and the departure time at the end of an existing one. This is a small but critical aspect of a homeowner’s duties and one that is often overlooked. Managing arrival and departure times is essential for ensuring a smooth transition of tenants, and will certainly strengthen your reputation as an efficient holiday homeowner.

Holiday lets: the agreement

Negotiating and agreeing a holiday let is very different from conventional letting agreements. Because holiday lets can only be termed as such if they one month or less in duration, they are not covered by the 1988 Housing Act.

Agreements for holiday lets are finalised either by exchange of a letter or via email, in which the property owner confirms the booking, and the terms and conditions of the let. The tenant responds by sending a deposit, either by BACS or by electronic transfer. The owner will then confirm the payment deadline for the remaining rent. The booking will only commence when the property owner has received full payment from the tenant.
